The medium bench session held on 24 June of this year, the Constitutional Court of Mongolia adjudicated the dispute as to whether Article 15.2 of the Law on Copyrights, which states that Succession of exclusive rights in joint works shall start on the day of death of the last surviving author, violates the Article 5.2 of the Constitution which states that “The State shall protect the rights of owners by law”, Article 7.2 “The intellectual values produced by citizens shall be the property of its authors”, Article 16.3 “The right to fair acquisition, possession and inheritance”, Article 16.8 “The right to benefits thereof” from notification from citizens D.Buyanzaya, L.Enkhtuya, J.Zorigtbaatar, S.Nominbayasgalan, his lawyer O.Bilguun.

The Constitutional Court adjudicated the dispute and concluded that the aforementioned provision is incompatible with Article 5.2 of the Constitution, which states that “The State shall protect the rights of owners by law”, Article 7.2 “The intellectual values produced by citizens shall be the property of its authors”, Article 16.3 “The right to fair acquisition, possession and inheritance” Article 16.8 “The right to benefits thereof”. Accordingly, the Constitutional Court suspended the aforementioned provision of the law with effect from 24 June of this year.

Member of Parliament P.Sainzorig presented Conclusion No. 05 of the Constitutional Court was discussed at the meeting of the Standing Committee on Legal Affairs to the plenary session of the Parliament.
